- 3D Facial Data: High-resolution 3D scans of your facial structure.

- Order Information: Billing address, shipping address, and payment confirmations.
- Usage Data: Information automatically collected about your interaction with our Site, such as device details, IP address, and cookies.
- Customer Support Information: Details you provide when interacting with us for support purposes.
2. How We Use Your Data
Your 3D facial data is processed solely to create a custom silicone mask. We will not use this data for other purposes unless you provide specific, separate consent.
If you give additional consent, your data may also be used to:
- Improve our products and services (optional).
- Showcase customized masks for marketing purposes (optional).
These additional uses are not required for mask creation and are subject to your explicit consent.

- Storage Location: All data is securely stored on Google Cloud servers in Oregon, United States.
- Security Measures: We implement robust security protocols, including encryption, restricted access, and secure storage, to protect your information from unauthorized access or misuse.
4. Data Sharing and Disclosure
We handle your data with care and share it only for specific purposes essential to creating your custom mask:
Photogrammetry Processing
Your photos are uploaded to the photogrammetry service Poly.cam to generate the initial 3D model. You can review their privacy policy to understand how they handle your data.
Manufacturing
Derivative files created from your 3D model are shared with third-party vendors solely to produce molds, frames, and lenses necessary for your custom mask.
Optional Data Usage
- Research and Development (5% Discount): If you opt to contribute your data to research and development, we will use it to advance the creation of low-cost, semi-custom masks.
- Marketing and Advertisement (10% Discount): If you agree to allow your data to be used for marketing purposes, it will only be utilized to showcase how our masks are tailored for different individuals. This may include images or renders demonstrating the customization process. Your data will not be shared with external advertisers.
Confidentiality
Your 3D facial data and resulting models are treated with strict confidentiality based on the options you select. We do not share your data with advertisers or external researchers.
You have full control over how your data is used and can choose to opt in or out of any optional data-sharing arrangements.
5. Pro-Active Data Deletion Option
We offer an optional Pro-Active Data Deletion clause:
- By selecting this option during checkout or in your account settings, your data will automatically be deleted from our systems within 30 days after your mask is delivered.
- You can choose to delete all data or just the biometric data.
- This proactive deletion process eliminates the need for a separate deletion request, though you can still contact us at nixdivemask@gmail.com to confirm deletion.
6. Your Rights
In line with GDPR, CCPA, and PIPEDA, you have the following rights regarding your personal data:
- Right to Access: Request a copy of the personal data we have collected about you. This includes access to your original 3D facial data but does not include access to the generated 3D models, which remain proprietary to Nix Dive Masks.
- Right to Data Portability: Receive your data in a structured, commonly used, and machine-readable format so you can share it with other entities.
- Right to Rectification: Request corrections to inaccurate or incomplete information.
- Right to Erasure (GDPR) / Right to Delete (CCPA and Canada): Request data deletion by contacting us at nixdivemask@gmail.com. If you select the Pro-Active Data Deletion option, deletion will occur automatically after product delivery.
- Right to Withdraw Consent: Revoke consent for optional uses like research and development or marketing at any time by contacting us.
- Right to Restrict Processing: Limit how we process your data, especially if you contest its accuracy or need it for legal claims.
- Right to Object: Under GDPR, object to our processing of your data for purposes such as direct marketing.
